Acknowledgement

1. By accepting the equipment for testing, you confirm that you have read,

understood, and agreed to these terms and conditions.

2. You confirm that you are physically fit and competent to use the equipment

provided by Jones Brothers Ltd for its intended purpose and that you will

follow all instructions provided regarding its use.

3. You declare that the information you have provided to Jones Brothers Ltd is

accurate and complete. This information will be used to help select and

configure suitable equipment for you. The ski boot and binding system has

been set up based on the details you submitted.

Loss and Damage

4. You acknowledge that Jones Brothers Ltd does not carry insurance covering loss

or damage of the equipment. You accept full responsibility for the care and

safekeeping of the equipment while it is in your possession, and you understand that

all use is at your own risk.

5. If the equipment suffers repairable damage due to misuse, you agree to cover the

reasonable cost of repairs as determined by Jones Brothers Ltd.

6. In the event that the equipment is lost, stolen, or damaged beyond repair, you

agree to notify Jones Brothers Ltd immediately and to cover the full replacement

cost. Irreparable damage may include, but is not limited to, broken skis, delaminated

edges, cracked topsheets, or severe base damage resulting from improper use

(such as skiing in rocky terrain). If the damage is assessed by Jones Brothers Ltd to

be due to a product fault, you will not be held liable for repair or replacement costs.

Personal Liability and Injury

7. You understand that snow sports involve inherent risks, including the potential for

serious injury, death, or property damage—even when equipment is properly

adjusted. Hazards may include falls, rocks, obstacles, and non-releasing bindings.

While correct binding settings and the use of protective gear (such as helmets) can

reduce risk, they cannot eliminate it. Jones Brothers Ltd and its staff, contractors,

agents, and affiliates make no guarantees regarding your safety or the safety of

others during testing.

8. To the maximum extent permitted by law, you release and indemnify Jones

Brothers Ltd (including its employees, contractors, agents, and affiliates) from any

liability, including for negligence, for any injury, damage, or loss arising from or

associated with your use of the equipment.

Governing Law

9. These terms and conditions are governed exclusively by the laws of New Zealand.
